1. Acceptance of Terms

By clicking the “I Agree” button, completing the registration process, making a purchase, or otherwise using the website, content, or services (collectively, the “Site“), you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site. The Site is owned and operated by AudiologyHub (the “Company,” “we,” “us,” or “our“), a corporation incorporated in the Province of Alberta, Canada, providing high-quality, affordable online education and courses for professionals in the field of Audiology.

2. AudiologyHub Subscriptions, Payments, and Refunds

2.1. Subscription and Access Each subscription is based on an annual fee and grants the subscriber non-transferable unlimited access to all courses in that specific professional area on AudiologyHub.org for the duration of the paid term. Unlimited access means that a subscriber may take as many courses as desired in that professional area at no additional cost. Subscription does not provide the subscriber with access to courses in other professional areas.

2.2. No Automatic Renewal Your subscription on the AudiologyHub Site will NOT be renewed automatically at the end of the subscription term. You will need to manually re-subscribe to continue access.

2.3. Payments and Pricing

  • We accept the following forms of payment: Visa, MasterCard, American Express, and Discover credit cards and/or other digital payment platforms that may be available at the time of purchase.
  • Billing occurs at the time of or shortly after your transaction.
  • You agree to pay for all products and services and authorize us to charge your credit card for all purchases, including any applicable taxes and fees.
  • All fees will be billed in United States Dollars (USD).
  • Prices for products and services offered by AudiologyHub may change at any time.

2.4. Final Sale and Refund Policy All sales of online services are final. The Site does not provide price protection, refunds, or prorated credits for any cancellation, non-use, or dissatisfaction, except as explicitly required by law.

3. Content Ownership and Intellectual Property

The Site and all its content, including but not limited to all courses, information, software, text, graphics, video, audio, code, and the design, selection, and arrangement thereof; along with all patent, copyright, trademark, trade dress, domain name, trade secret and other proprietary rights relating thereto (collectively the “Content“), are the intellectual property of AudiologyHub and are protected by Canadian, United States, and international copyright, trademark, patent, and trade secret laws.

3.1. Restrictions on Use You are granted a limited, non-exclusive, non-transferable license to access and use the Content for your own personal, non-commercial, and professional educational purposes only. You must not:

  • Copy, modify, reproduce, distribute, or publicly display any of the Content.
  • Share your account credentials or subscription access with any third party.
  • Use the Content for any commercial purposes without the express written consent of AudiologyHub.
  • Use the Content, or any data derived from the Content, for the development, training, or testing of any machine learning, artificial intelligence, or other generative model.

4. User Conduct and Account Termination

4.1. Account Security You are responsible for maintaining the confidentiality of your account password and other personal information. You agree to notify us immediately of any unauthorized use of your account.

4.2. Prohibited Conduct Any abuse of the Site or its Content, including but not limited to the abuse of any free course offerings, plagiarism, cheating, harassment, or unlawful activity, is considered a violation of these Terms.

4.3. Termination Rights We have the right to disable any account, username, or password at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms. Upon termination, your right to access the Site and its Content will immediately cease, and you will not be entitled to any refund.

5. Educational Use and Professional Advice Disclaimer

The Content is for educational and informational purposes only. It is provided to enhance professional knowledge and is not a substitute for the independent professional judgment of a healthcare provider, nor is it a substitute for individualized, patient-specific medical, legal, or other professional advice.

We are not responsible for any actions taken or not taken based on the Content, nor for any professional, medical, or other consequences that may result from the use of the Content. Reliance on any information provided by AudiologyHub is solely at your own risk.

6. Limitation of Liability and Warranties

6.1. Disclaimer of Warranties The Site and Content are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. We do not warrant that the Content will be accurate, reliable, complete, error-free, or continuously available.

6.2. Limitation of Liability To the fullest extent permitted by law, in no event will AudiologyHub, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site or Content. This includes direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, or loss of data.

In all cases, our total liability to you for any and all claims arising out of or related to these Terms or the Site will not exceed the amount you paid to us for the services in the twelve (12) months immediately preceding the event giving rise to the claim.

7. Governing Law and Dispute Resolution

7.1. Governing Law These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada, without giving effect to any choice or conflict of law provision or rule.

7.2. Mandatory Binding Arbitration Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be settled by final and binding arbitration in Calgary, Alberta, before a single arbitrator. This arbitration must be initiated within one (1) year after the cause of action accrues. You and the Company agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

7.3. Exceptions to Arbitration Notwithstanding the above, either party may bring an individual action in a small claims court with jurisdiction in Calgary, Alberta, and either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

8. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. For any material changes, we will use reasonable efforts to provide notice (e.g., via email or a prominent notice on the Site).
